Terms of Service

  1. Introduction
    1. This document (the "Agreement", the "Terms") gives you information about EveCloud ("us", "we", "our") and sets out the legal terms and conditions on which we may provide services (referred to within this Agreement as "Service" or collectively as "Services") to our clients ("customer", "you", "your") through our website.
    2. By using or accessing our Services, you are bound by these Terms. If you do not agree to abide by this Agreement, you are not authorized to use our Services.
    3. We reserve the right to amend the Terms at any time without notice. It is your responsibility to periodically check for any changes to the Terms.
  2. Account Eligibility
    1. EveCloud Services are not available to persons under the age of 13. If you are between the ages of 13 and 18 (or between 13 and the age of legal majority in your jurisdiction of residence), you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
    2. Upon registration and at all other times, it is your responsibility to provide true, current and accurate information which is completed to the best of your knowledge. Providing fraudulent information may result in the immediate termination of your Services and/or account.
    3. Upon purchase of our Services, in some cases, you may be required to prove your identity by providing us with government-issued identification and possibly a scan of the credit card used to make the purchase. Failure to provide this information upon request will result in the immediate cancellation of your order and may also result in your account being terminated.
  3. Payments
    1. EveCloud shall not be liable whatsoever for any extra fees that may arise during the payment for your Services.
    2. Once provided, to prevent disruption to your Services, you agree to be billed automatically regularly via your credit card or other billing information you have on file with us.
    3. EveCloud reserves the right to change prices or any other charges at any time. It is your responsibility to periodically review billing information provided by EveCloud through the client area or through other methods of communication, including any notices sent or posted by EveCloud.
    4. If you wish to cancel your Services, this must be done via our website before the end of the current billing period. You are liable for any accidental charges you incur due to the failure to cancel your Services.
    5. If you wish to cancel a dedicated server, you are required to cancel it 15 days before the end of the current billing period, failure to do so will result in you being charged for the next billing period.
    6. Failure to provide payment for your Services entitles us to request the owed amount from external debt collectors or financial institutions.
  4. Fraud
    1. Fraudulently using credit cards, electronic cheques, or any other payment method is a violation of this Agreement. We may report such actions to law enforcement and other organisations such as credit card companies and/or financial institutions.
    2. If personal information on any account or service information is incorrect, or fraudulent, EveCloud is entitled to the right to suspend or irreversibly terminate services of the account without any prior warning.
  5. Abuse
    1. Using our services for providing anything illegal or using it against its intended use is not permitted. Services that appear to be abusing may be suspended or terminated without warning.
    2. If you would like to report abuse or suspicious activity from a customer, you may contact our abuse department via email at [email protected] or our online ticket system.
  6. Support
    1. EveCloud has the choice regarding whether they provide support for products or services unless specified elsewhere on their official website.
    2. If an individual or group maliciously attacks, spams or raids our system with tickets, or through Discord, we reserve the right to permanently ban them from our support services resulting in no support for the person. If we receive verbal abuse, we reserve the right to irreversibly terminate your services without warning. Verbal abuse includes but is not limited to swearing and showing continued anger towards us.
    3. EveCloud reserves the right to refuse support to any outdated product, service or version due to potential security issues or any other reason specified.
  7. Refunds
    1. If the Service is your first with us, we offer a period of up to 24 hours in which you may request a refund for your Service by creating a support ticket on our website. This excludes dedicated servers, installation fees and administration fees unless otherwise stated.
    2. If for any reason EveCloud has identified you using your product in any way which violates this terms of service, you are not entitled to a refund.
    3. Refunds are not available through all payment gateways. In the event a refund is unavailable and/or not possible, account funds or "credits" will be provided.
    4. Cancelling your Service via our website will make that Service ineligible for a refund in future.
  8. Termination
    1. EveCloud may terminate your access to the Services, in whole or in part, without notice in the event that: (i) you fail to pay any fees due; (ii) you violate this Agreement; (iii) your conduct may harm EveCloud or others or cause EveCloud or others to incur liability, as determined by EveCloud in our sole discretion; or (iv) as otherwise specified in this Agreement.
    2. In such event, EveCloud shall not refund to you any fees paid in advance of such termination, and you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such termination.
    3. Additionally, EveCloud may charge you for all fees due for the Services for the remaining portion of the then-current term. UPON TERMINATION OF THE SERVICES FOR ANY REASON, USER CONTENT, USER WEBSITES, AND OTHER DATA WILL BE DELETED.
  9. Disputes
    1. Any dispute or chargeback of payment to EveCloud will result in the immediate termination of all Services associated with your account. In some cases, this may be reversed under some circumstances such as the dispute being resolved.
  10. Data
    1. You may be able to upload, store, publish, display and distribute information, text, photos, videos and other content on or through the Services (collectively, "User Content"). User Content includes any content posted by you or by users of any of your websites hosted through the Services ("User Websites"). You are solely responsible for any and all User Content and any transactions or other activities conducted on or through User Websites.
    2. By posting or distributing content through your Services, you consent to EveCloud that (i) you have all the necessary rights to post or distribute such content; and (ii) posting or distribution of such content does not infringe or violate the rights of any other third party. EveCloud reserves the right to intervene and possibly terminate your Services in cases where you infringe or violate the rights of a third party.
    3. EveCloud will not be liable whatsoever for any content hosted by our clients on our systems or any actions we may take in removing content. Although we do not monitor this content, we reserve the right to immediately take corrective action such as completely or partially removing content or suspending or terminating any and all Services without refund if you violate the Terms.
